Please read these Terms carefully before engaging with our services. If you do not agree with any part of these Terms, you should not use our website or services.
In these Terms, the following definitions apply:
When you make a booking with us, you are offering to purchase our services subject to these Terms. All bookings are subject to availability and confirmation by us. A contract between you and Aussie Adventure Tours is formed when we send you a booking confirmation.
You must be at least 18 years of age to make a booking. Bookings for minors must be made by a parent or legal guardian.
To secure your booking, a non-refundable deposit of 20% of the total tour price is required at the time of booking. The final payment is due 60 days before the departure date. For bookings made within 60 days of departure, full payment is required at the time of booking.
We accept payment by credit card (Visa, MasterCard, American Express), bank transfer, and PayPal. All payments must be made in Australian Dollars (AUD).
All prices are quoted in Australian Dollars (AUD) and include GST where applicable. Prices are subject to change until full payment is received and your booking is confirmed. After confirmation, prices may still change due to factors beyond our control, such as currency fluctuations, government actions, or increases in transportation costs. If the price increase exceeds 10% of the total tour price, you have the right to cancel and receive a full refund.
If you need to cancel your booking, you must notify us in writing. The following cancellation fees apply:
We strongly recommend purchasing travel insurance to protect against unforeseen circumstances that may require cancellation.
If you wish to make changes to your booking (such as changing dates or tour), you must notify us in writing. We will make every effort to accommodate your request, but we cannot guarantee that changes will be possible. A change fee of AUD 100 per person may apply, in addition to any difference in tour price.
We reserve the right to cancel or make changes to any tour due to circumstances beyond our control, including but not limited to natural disasters, political instability, terrorism, health concerns, or insufficient participation. If we cancel a tour, you may choose between a full refund or an alternative tour of equal value. If the alternative tour is of lower value, we will refund the difference.
If we make significant changes to a tour after booking, you have the right to accept the changes or cancel and receive a full refund. Minor changes do not entitle you to cancel or receive compensation.
You are responsible for obtaining all necessary travel documentation, including valid passports, visas, and health certificates, for all destinations on your tour. We will provide general information on these requirements, but it is your responsibility to ensure compliance with all entry, health, and other requirements of the countries you visit.
Our tours may require a certain level of physical fitness and good health. You must inform us at the time of booking of any medical conditions, disabilities, or special requirements that may affect your ability to participate in the tour. We reserve the right to refuse a booking or remove a person from a tour if, in our opinion, their participation may endanger them or others, or impact the enjoyment of other travelers.
Comprehensive travel insurance is mandatory for all travelers booking our tours. Your insurance must cover at minimum: medical expenses, emergency repatriation, personal liability, cancellation, curtailment, and loss of luggage and personal effects. You may be required to provide proof of your travel insurance policy prior to departure.
You agree to comply with all reasonable instructions of tour leaders, local guides, and transportation providers during your tour. You also agree to respect local customs, traditions, and environmental regulations. We reserve the right to terminate your participation in a tour if your behavior is, in our reasonable opinion, causing danger, distress, or annoyance to others or damaging property. In such cases, no refund will be provided.
To the extent permitted by law, Aussie Adventure Tours shall not be liable for any loss, injury, death, damage, accident, delay, or irregularity that may be caused during any tour, whether due to the acts, omissions, or negligence of any third-party providers of services associated with the tour.
Our liability to you for claims not related to personal injury, death, or illness and not arising from our negligence or willful misconduct will be limited to a maximum of the cost of your tour.
We will not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay is due to causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, strikes, health epidemics, government actions, or technical failures.
Our tours may include services provided by third parties, such as accommodation, transportation, and activities. While we select these providers with care, we do not control their operations and are not responsible for their actions or omissions. Any complaints or claims related to third-party services should be addressed directly to the service provider.
All content on our website, including text, graphics, logos, images, audio clips, and software, is the property of Aussie Adventure Tours or its content suppliers and is protected by Australian and international copyright laws. You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written consent.
If you submit content to our website (such as reviews, comments, or photos), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content worldwide in any media.
You agree not to use our website for any unlawful purpose or in any way that might damage, disable, or impair the site or interfere with any other party's use of the site. You also agree not to attempt to gain unauthorized access to any parts of the site, other accounts, or computer systems through hacking, password mining, or any other means.
Any dispute arising out of or related to these Terms shall be resolved through friendly negotiation. If the dispute cannot be resolved through negotiation, it shall be submitted to arbitration in Sydney, Australia, in accordance with the rules of the Australian Centre for International Commercial Arbitration. The arbitration award shall be final and binding on both parties.
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our website or services after any changes indicates your acceptance of the modified Terms. We recommend that you check these Terms periodically for any changes.
